อนุญาโตตุลาการ, Example:การระงับข้อพิพาททางเลือก (alternative dispute resolution) วิธีหนึ่ง โดยการที่คู่กรณีตกลงเสนอข้อพิพาทให้บุคคลหรือคณะบุคคลที่เรียกว่า “อนุญาโตตุลาการ” ทำหน้าที่พิจารณาชี้ขาดข้อพิพาทนั้น และคู่กรณีตกลงที่จะเห็นด้วยตามคำชี้ขาดของอนุญาโตตุลาการ ทั้งนี้ สำนักงานได้จัดให้มีกระบวนการระงับข้อพิพาทโดยอนุญาโตตุลาการตามนโยบายของคณะกรรมการ ก.ล.ต. ที่เห็นสมควรให้มีมาตรการคุ้มครองสิทธิของผู้ลงทุนซึ่งเป็นลูกค้าของผู้ประกอบธุรกิจหลักทรัพย์หรือที่เกี่ยวเนื่องกับธุรกิจหลักทรัพย์ หรือผู้ประกอบธุรกิจสัญญาซื้อขายล่วงหน้า เนื่องจากมีผู้ลงทุนได้รับความเสียหายจากการที่ผู้ประกอบการดังกล่าวไม่ปฏิบัติตามสัญญา หรือไม่ปฏิบัติให้เป็นไปตามกฎหมายว่าด้วยหลักทรัพย์และตลาดหลักทรัพย์ กฎหมายว่าด้วยสัญญาซื้อขายล่วงหน้า หรือกฎหมายว่าด้วยกองทุนสำรองเลี้ยงชีพ ซึ่งการที่ผู้ลงทุนจะได้รับการชดเชยความเสียหายดังกล่าวอาจมีภาระค่าใช้จ่ายที่สูงมากจนไม่คุ้มกับความเสียหายที่ได้รับ หรืออาจต้องใช้ระยะเวลานานในการดำเนินการตามกระบวนการยุติธรรมทั่วไป จึงได้เพิ่มช่องทางให้ผู้ลงทุนมีทางเลือกในการเรียกร้องค่าเสียหายจากผู้ประกอบการผ่านวิธีอนุญาโตตุลาการ ซึ่งเป็นวิธีการระงับข้อพิพาทที่สะดวก รวดเร็ว เป็นธรรม และประหยัดค่าใช้จ่าย โดยกำหนดกระบวนการระงับข้อพิพาทเป็น 2 ขั้นตอน ได้แก่ ขั้นตอนแรก คือ กระบวนการรับข้อร้องเรียนภายในของผู้ประกอบธุรกิจหลักทรัพย์หรือที่เกี่ยวเนื่องกับธุรกิจหลักทรัพย์ หรือผู้ประกอบธุรกิจสัญญาซื้อขายล่วงหน้า โดยเมื่อมีข้อพิพาทเกิดขึ้นระหว่างผู้ลงทุนกับผู้ประกอบการดังกล่าว ผู้ลงทุนต้องดำเนินการร้องเรียนตามกระบวนการรับข้อร้องเรียนภายในของผู้ประกอบการก่อน ขั้นตอนที่สอง คือ กระบวนการระงับข้อพิพาทโดยวิธีอนุญาโตตุลาการของสำนักงาน โดยในกรณีที่ไม่สามารถระงับข้อพิพาทได้ในขั้นตอนแรก เช่น ลูกค้าและผู้ประกอบการไม่สามารถตกลงกันได้ หรือผู้ประกอบการไม่ได้ดำเนินการแก้ไขปัญหาข้อร้องเรียนภายในระยะเวลาที่กำหนด เป็นต้น คู่กรณีสามารถเข้าสู่กระบวนการระงับข้อพิพาทโดยวิธีอนุญาโตตุลาการ โดยผ่านการตกลงด้วยความสมัครใจของทั้งสองฝ่ายหากเป็นข้อพิพาทเกี่ยวกับธุรกิจหลักทรัพย์หรือกองทุนสำรองเลี้ยงชีพ หรือเข้ามาโดยผลของกฎหมายผ่านการแสดงความประสงค์เป็นหนังสือของลูกค้าไปยังผู้ประกอบการหากเป็นข้อพิพาทเกี่ยวกับการประกอบธุรกิจสัญญาซื้อขายล่วงหน้า ทั้งนี้ ไม่ว่าในกรณีใด ผู้ร้องสามารถเลือกที่จะให้สำนักงานเป็นผู้ไกล่เกลี่ยข้อพิพาทก่อนเริ่มกระบวนการอนุญาโตตุลาการได้ หากคู่กรณียังไม่สามารถตกลงกันได้จึงจะเข้าสู่กระบวนการระงับข้อพิพาทโดยวิธีอนุญาโตตุลาการต่อไป [ตลาดทุน]
