คือความละเมิดมิได้จากสถานที่ของคณะผู้แทน หมายความว่า บ้านของตัวแทนทางการทูต รวมทั้งสถานที่อื่น ๆ ที่ใช้เพื่อจุดประสงค์ทางการทูต รวมถึงตึกรามใด ๆ ที่ผู้แทนทางการทูตใช้ดำเนินงานทางการทูตในตำแหน่งที่ของเขา ไม่ว่าสถานที่นั้น ๆ จะเป็นทรัพย์สินของรัฐบาลของเขาหรือเป็นของเขาเอง หรือแม้แต่เป็นสถานที่ที่ให้ตัวแทนทางการทูตเช่า เหล่านี้จะได้รับความคุ้มกัน (Immunity) ทั้งสิ้น นอกจากนี้ เจ้าหน้าที่ของรัฐผู้ใด โดยเฉพาะเจ้าที่ตำรวจ เจ้าหน้าที่เก็บภาษี หรือเจ้าหน้าที่ศาล จะเข้าไปในที่อยู่หรือทำเนียบของผู้แทนทางการทูตมิได้ นอกจากจะได้รับความยินยอมให้กระทำเช่นนั้นอย่างไรก็ดี หากเกิดอาชญากรรมขึ้นภายในสถานที่ของคณะผู้แทน หรือในที่อยู่ของตัวแทนทางการทูต โดยบุคคลซึ่งมิได้อุปโภคความละเมิดมิได้ ตัวแทนทางการทูตผู้นั้นจะต้องมอบตัวอาชญากรดังกล่าวให้แก่รัฐบาลท้องถิ่นตาม ที่ขอร้อง กล่าวโดยทั่วไป ตัวแทนทางการทูตจะยอมให้ที่พักพิงในสถานทูตแก่อาชญากรใด ๆ ไม่ได้ เว้นแต่ในกรณีที่เห็นว่าอาชญากรผู้นั้นตกอยู่ในอันตรายที่จะถูกฆ่าจากฝูงชน ที่ใช้ความรุนแรง ก็จะยอมให้เข้าไปพักพิงได้เป็นกรณีพิเศษในเรื่องนี้ อนุสัญญากรุงเวียนนาว่าด้วยความสัมพันธ์ทางการทูต ได้กล่าวไว้ในข้อ 22 ดังนี้ ?1. สถานที่ของคณะผู้แทนจะถูกละเมิดมิได้ ตัวแทนของรัฐผู้รับไม่อาจเข้าไปในสถานที่นั้นได้ เว้นแต่ด้วนความยินยอมของหัวหน้าคณะผู้แทน 2. รัฐผู้รับมีหน้าที่พิเศษที่จะดำเนินการทั้งมวลที่เหมาะสม เพื่อคุ้มครองสถานที่ของคณะผู้แทนจากการบุกรุกหรือความเสียหายใด ๆ และที่จะป้องกันการรบกวนใด ๆ ต่อความสงบสุขของคณะผู้แทน หรือการทำให้เสื่อมเสียเกียรติ 3. สถานที่ของคณะผู้แทน เครื่องตกแต่ง และทรัพย์สินอื่นของคณะผู้แทนในสถานที่นั้น ตลอดจนพาหนะในการขนส่งของคณะผู้แทน ให้ได้รับความคุ้มกันจาการค้น การเรียกเกณฑ์ การอายัด หรือการบังคับคดี ? สถานที่ของคณะผู้แทน คือ อาคารหรือส่วนของอาคารและที่ดินซึ่งอาคารตั้งอยู่ ซึ่งใช้เพื่อความมุ่งประสงค์ของคณะผู้แทนโดยไม่คำนึงถึงกรรมสิทธิ์ รวมถึงที่อยู่ของหัวหน้าคณะผู้แทนด้วย [การทูต]
