| Commencement of the Functions of the Head of Diplomatic Mission | การเริ่มต้นรับหน้าที่ของหัวหน้าคณะผู้แทนทางการ ทูต กล่าวคือ เมื่อหัวหน้าคณะผู้แทนทางการทูตเดินทางไปถึงนครหลวงของประเทศผู้รับแล้ว ควรรีบแจ้งให้รัฐมนตรีว่าการกระทรวงการต่างประเทศทราบว่า ตนได้เดินทางมาถึงแล้วและขอนัดเยี่ยมคารวะ ตามปกติกระทรวงการต่างประเทศ ซึ่งเป็นหน้าที่ของอธิบดีกรมพิธีการทูตจะดำเนินการตระเตรียมให้หัวหน้าคณะ ผู้แทนทางการทูตได้เข้ายื่นสารตราตั้งต่อไประหว่างนั้น หัวหน้าคณะผู้แทนทางการทูตจะต้องไม่ไปพบเยี่ยมผู้ใดเป็นทางการ จนกว่าจะได้ยื่นสารตราตั้งเรียบร้อยแล้ว อย่างไรก็ดี หัวหน้าคณะผู้แทนอาจขอพบเป็นการภายในกับหัวหน้าของคณะทูตานุทูต (Dean หรือ Doyen of the Diplomatic Corps) ได้ เพื่อขอทราบพิธีการปฏิบัติในการเข้ายื่นสารตราตั้งต่อประมุขของประเทศผู้รับ เกี่ยวกับเรื่องนี้ อนุสัญญากรุงเวียนนา ได้บัญญัติไว้ในมาตรา 13 ว่า1. พึงถือได้ว่าหัวหน้าคณะผู้แทนได้เข้ารับภารกิจหน้าที่ของตนในรัฐผู้รับ เมื่อตนได้ยื่นสารตราตั้งหรือเมื่อตนได้บอกกล่าวการมาถึงของตน พร้อมทั้งได้เสนอสำเนาที่ถูกต้องของสารตราตั้งต่อกระทรวงการต่างประเทศของ รัฐผู้รับ หรือกระทรวงอื่นตามที่อาจจะตกลงกันในแนวปฏิบัติที่มีอยู่ในรัฐผู้รับ ซึ่งจะต้องใช้ในทำนองอันเป็นเอกรูป2. ลำดับของการยื่นสารตราตั้ง หรือสำเนาที่ถูกต้องของสารตราตั้ง จะได้พิจารณากำหนดตามวันและเวลาของการมาถึงของหัวหน้าคณะผู้แทน [การทูต] |
